Ondo Election: Senator Ibrahim Requests Court to Annul Aiyedatiwa’s Nomination

Due to the disputable primary election that resulted in Aiyedatiwa being selected as the All Progressives Congress (APC) candidate for the November Governorship election in Ondo State. Senator Jimoh Ibrahim filed a lawsuit against the APC, the Independent National Electoral Commission (INEC), and the Governor of Ondo State, Lucky Orimisan Aiyedatiwa, before a Federal High Court in Abuja.
Ibrahim, the Senator from Ondo South, is pleading with the Court to annul Aiyedatiwa’s nomination as the APC’s nominee, citing illegality in the primary election held on April 20, 2024. Ibrahim, a candidate for Governorship Election who ran in the primaries, claimed in the suit that was filed on his behalf by Chris Uche, a Senior Advocate of Nigeria (SAN), that there were numerous discrepancies in the poll, among other things, the APC gravely breached sections 221 and 228 of the 1999 Constitution and 84 of the Electoral Act 2022 in the way it conducted the controversial primary election.
He contended that several delegates who were eligible to cast ballots for him in the primary election were not granted voting credentials, possibly leading to the primary election being void and disregarded. He requested that the Court strike the names of the APC and Governor Aiyedatiwa off the list of political parties and stop INEC from endorsing Aiyedatiwa as the APC candidate for Governor of Ondo State in the next November 16 governorship election.
A permanent injunction that would forbid Governor Aiyedatiwa from presenting himself or holding himself out as the APC’s candidate for Ondo election for gubernatorial poll was also requested by the Senator, He also asked the Court to declare the alleged primary election invalid and order the APC to hold a new one in accordance with sections 221, 228 of the 1999 Constitution, and 84 of the Electoral Act 2022.
The lawsuit additionally asked that all powers be taken away from the APC and Governor Aiyedatiwa, with the exception of holding new primary elections that are legitimately held in order to nominate candidates for governorship elections.
Aiyedatiwa was served with Court papers on Wednesday, 8 May 2024, through APC staff working in the National Secretariat in Abuja, according to an ex-parte application made by Senator Ibrahim and his Attorney.
After granting the motion, Justice Inyang Edem Ekwo issued a brief ruling directing the APC to serve the Ondo State Governor with the lawsuit’s process. The suit hearing was then fixed for May 14 by Justice Ekwo.
